REMUNERAÇÃO NA APOSENTADORIA POR IDADE DA PCD
PARA QUEM COMPLETOU OS REQUISITOS ATÉ A REFORMA DA PREVIDÊNCIA (12/11/2019):
O cálculo deve considerar a média dos seus 80% maiores salários de contribuição desde julho de 1994. Assim, a remuneração mensal inicial será de 70% dessa média + 1% ao ano de contribuição.
JÁ PARA QUEM COMPLETOU OS REQUISITOS A PARTIR DO DIA 13/11/2019 (DATA DE ENTRADA EM VIGOR DA REFORMA DA PREVIDÊNCIA):
O cálculo considerará a média de todos os salários de contribuição desde julho de 1994. E, da mesma forma (porque a reforma não trouxe alteração para a aposentadoria do PCD), o cálculo da renda mensal será 70% dessa média + 1% ao ano de contribuição.
Boa notícia é que a Reforma da Previdência não trouxe uma alteração específica em relação ao cálculo da aposentadoria da PcD, o que significa dizer que, judicialmente, é possível que seja reconhecido o direito à regra de cálculo anterior à Reforma (média dos 80% maiores salários de contribuição).
APOSENTADORIA POR TEMPO DE CONTRIBUIÇÃO DA PCD
A aposentadoria da pessoa com deficiência por tempo de contribuição não exige idade mínima, contudo, o grau da deficiência vai determinar o tempo mínimo de contribuição.
O grau de deficiência é verificado mediante perícias, médica e por uma avaliação biopsicossocial, no INSS.

Mulher: 20 anos de tempo de contribuição
Homem: 25 anos de tempo de contribuição
Deficiência de grau médio:
Mulher: 24 anos de tempo de contribuição

É possível, ainda, que o segurado tenha trabalhado por algum tempo sem apresentar deficiência e posteriormente tenha sido afetado por alguma condição de deficiência (física, mental, intelectual ou sensorial).
Para casos como esse é possível converter o tempo de contribuição “comum” em tempo de contribuição da pessoa com deficiência, seguindo as tabelas de conversão de tempo, antecipando, assim, a aposentadoria desse segurado.
E A PCD QUE NUNCA CONTRIBUIU AO INSS, TEM DIREITO À APOSENTADORIA DA PESSOA COM DEFICIÊNCIA?
Quem nunca contribuiu não tem direito à aposentadoria. Contudo, a legislação garante à pessoa com deficiência que nunca contribuiu para o INSS o Benefício de Prestação Continuada – BPC, no valor de 1 salário-mínimo, desde de que cumpridos os demais requisitos legais.
